1.
General Terms & Conditions
Please read the following information carefully. If you decide to
travel on a trip with Midnight Sun Adventure Travel and make payment
on a tour, you thereby agree to accept the terms and conditions
of this contract.
2.
Reservation
Policy
A deposit of $500 of the tour price must be received at the time
of booking to confirm your reservation. Full payment is required
60 days prior to departure. While
all prices are in Canadian funds when your credit card is processed
the transaction should reflect the current rate of exchance for
non-Canadian customers.
3.
Cancellation Policy
Upon
receiving written notice of the cancellation, the following schedule
will apply:
- 61
days or more prior to tour departure: full refund, less a $50
processing fee.
- 60
- 0 days prior to departure: no refund will be given.
If
you must cancel, we will be as understanding as possible and will
make every effort to be flexible.
4.
Harmonized Sales Tax (HST)
As of July 1, 2010, all prices are subject to 12% HST that will
be added to your invoice upon confirmation of booking. A
portion of this tax may be refundable to non-Canadian residents.

5.
Rates do not include: GST
or HST, personal accident insurance, cancellation insurance, gratuities
and baggage handling.
6.
Possible Alterations
Midnight Sun Adventure Travel reserves the right to cancel any trip
prior to tour departure. Reasons may include, but are not limited
to, unforeseen circumstances associated with operating in wilderness
and remote areas, or insufficient bookings. If we do not
have our minimum number of guests to feasibly run a trip we will
notify you 30 days prior to departure and will refund you the full
amount. Midnight Sun Adventure Travel is not responsible for any
additional costs that may arise in the event a trip is altered or
delayed for reasons beyond our control.
7.
Supplier's Liabilities
Midnight Sun Adventure Travel acts as an agent for and makes arrangements
with airlines, hotels, kayak companies and operators, bus lines,
and other independent parties to provide you with travel products,
including services and accommodations. Although great care is taken
to choose suppliers, we are unable to directly control them and,
therefore, we are not responsible for their acts or omissions. The
travel services provided by these suppliers are subject to the conditions
imposed by the suppliers and their liability may be limited by their
tariffs, conditions of carriage, international conventions and agreements.
8.
Company Liability
Customers
will be required to complete a liability release form, which will
send to you as part of your pre-departure package. Additionally,
Midnight Sun Adventure Travel and their respective officers, directors,
servants and agents are not responsible for any claims, loss, damage,
cost liability or expense arising, direct or indirect, out of injury,
accident or death, loss, damage or delay of baggage or other property,
or delay, inconvenience, loss of enjoyment, upset, disappointment,
distress or frustration, whether physical, mental, or otherwise
relating to the provision of travel services including kayak tours,
other trips and tours and accommodations.
9.
Force Majeure
Midnight Sun Adventure Travel will not be responsible for the performance
of this agreement if prevented or delayed by Acts of God, strikes,
accidents, weather, traffic, airport conditions or other causes
beyond their reasonable control nor will they be responsible for
any loss or damage relating to train cancellations or any other
cancellations.
10.
Baggage
Guests travelling on our overland tours are limited to one suitcase
or duffle bag per person with a weight not to exceed 50 lbs (27
kg). This baggage will be carried in the rear of the vehicle or
in the covered roof rack of the vehicle. Overland passengers may
also bring a small carry-on bag with them in the vehicle. Luggage
on kayak tours will be limited to the amount of space available
in dry bags, which are carried in the kayak. Some gateway hotels
on our kayak tours allow their guests to store luggage.
Notes
About Passports, Visas and Health Regulations
Everyone traveling by AIR between the United States and Canada,
Mexico, Central and South America, the Caribbean and Bermuda is
required to present a valid passport, air NEXUS card, or U.S. Coast
Guard Merchant Mariner Document.
As early as 1 January 2008, and no later than 1 June 2009, everyone
traveling between the United States and Canada, Mexico, Central
and South America, the Caribbean, and Bermuda by LAND or SEA (including
cruises and ferries) may be required to present a valid passport
or other documents as determined from the Department of Homeland
Security.
